Yes to Mosque in Murfreesboro, Tennessee the Judge Rules Triumph for Constitution




Although, Muslim and Islam haters dominate this southern Bible-belt state of Tennessee the US constitution, the court system and honorable judges offer Muslims a refuge. One needs to see the outcome of the construction of Islamic centers at lower Manhattan, New York where thousands and thousands of Muslims workers need place to worship on Fridays close by for their brief lunch break.

The Rutherford County Chancery Court reached a decision in the case of Fisher vs. the county on the issue of the proposed Veals Road mosque, Wednesday, November 17th. Counselor Smith for the plaintiff began his opening statements by invoking the words of Thomas Jefferson, insisting that the Islamic Center of Murfreesboro’s actions presented a “clear and present danger” to the citizens of Rutherford County, regardless of if their alleged activities actually caused any harm. He argued there was a compelling public interest to issue a temporary injunction on construction of the mosque, and that Rutherford County, and furthermore all of America, need to be brought “out of the shadows of Sharia, and into the light of freedom.” Josh McCreary, counsel for the county, summarized the defendant’s case by pointing out that no commissioners testified to a pre-meeting meeting, where they were said to have been warned about voting down the site plans; no criminal activity was uncovered by a sheriff’s department investigation into the burial held on the grounds of the proposed mosque, and that the plaintiff presumable altogether abandoned the original object of their desire, a restraining order, thus fundamentally changing the nature of the case.
Furthermore, he called out counselor Joe Brandon on the gratuitous use of comparisons between Osama bin Laden and the applicant, for which no evidence was ever produced.
It also warrants mention that throughout the entire trial, never once did Kevin Fisher, who filed the suit, or any members from the Islamic Center of Murfreesboro actually take the stand for either side.
Brandon was up next with a rebuttal, in which he levied new allegations against Mayor Burgess, contending that his acquaintance with the applicant for and land owner of the property in question was highly suspicious and implied that it involved the exchange of money.
In addressing Islamic law, Brandon said that Islam could “stick it”, and that he’d say “no thanks” to it, going on to liken the Islamic Center to a man with a knife hiding in the darkened corner of a child’s bedroom.
In responding to assertions that the court had become a “circus”, Brandon simply pointed to the defendant, saying “they pitched the tent and brought the clowns”.

After an hour long recess, Chancellor Corlew returned with his verdict, which he himself took an hour to deliver, outlining his choices.
In the end, a temporary injunction was denied, the county was not found to be in error in its proceedings, and construction on the mosque will continue.
Corlew did stress the preliminary nature of the ruling, should Fisher and company choose to appeal. And they most certainly do.
Brandon said in court that he would return to try the case again. Brandon was not available for comment on this round though; he ran into a nearby bathroom when approached by WGNS, leaving his belongings on the floor in his haste.
The county withheld celebration as well, knowing this is far from over. Of course, if any subsequent developments unfold, you’ll hear about them here first.

The Murfreesboro Post states that the four individuals behind the anti-mosque lawsuit are Kevin Fisher, James Estes, Henry Golczynski, and Lisa Moore. One of those behind the anti-mosque lawsuit is scheduled to meet with U.S. Secretary of Defense Robert Gates on September 23 in Washington DC and receive a "Freedom Award" as confirmed by WGNS radio in Murfreesboro.
